TriedThat Terms of Service

These Terms of Service (“Terms”) govern your access to and use of TriedThat, a mobile application operated by Lashachi Inc., a Canadian company (“Lashachi,” “we,” “us,” or “our”).By accessing or using TriedThat, you agree to these Terms.If you do not agree to these Terms, do not use TriedThat.

1. About TriedThat

TriedThat is a private pet profiles and memories app designed to help you remember things your pet has tried, how your pet responded, and help you record optional personal notes about your pet's preferences.TriedThat is not intended to operate as a public review platform, social network, veterinary service, or pet-care marketplace.Features may change as TriedThat develops.

2. Eligibility

You must be at least 18 years old to create an account or use TriedThat.By creating an account or using TriedThat, you represent that you are at least 18 years old and legally capable of entering into these Terms.TriedThat is not intended for use by individuals under 18 years of age. If we learn that an account is being used by an individual under 18, we may take reasonable steps to restrict or terminate the account and address associated personal information in accordance with applicable law.

3. Accounts

Some or all TriedThat functionality requires an account.You agree to provide accurate information where requested and to maintain the security of access to your email account and devices.You are responsible for activity occurring through your TriedThat account.If you believe your account has been accessed without authorization, contact [email protected].

4. Private Pet Profiles and Memories

TriedThat allows you to create private memories about things your pet has tried and experiences you want to remember.A memory may include:• pet name;
• species;
• optional profile photo;
• optional pet note;
• item/experience tried;
• reaction;
• date;
• optional memory/experience note, if applicable; and
• other organizational information actually collected.
TriedThat is designed so that these memories are private to your account and are not published to other TriedThat users through the current service.

5. Free Accounts

TriedThat may provide a Free account tier.The current Free tier may limit the number of server-saved memories available to an account.At launch, the intended Free limit is up to three server-saved memories.We may modify Free-tier limits or functionality in the future, subject to applicable law and any notice we determine is appropriate.

6. TriedThat Solo

TriedThat offers an optional paid subscription called TriedThat Solo.Solo provides the premium features described in the app, which may include unlimited server-saved memories.The specific features included with TriedThat Solo will be displayed in the app and may evolve as the service develops.

7. Subscriptions and Automatic Renewal

TriedThat Solo may be offered on a monthly or annual subscription basis, depending on the options available through the applicable app store.Before purchasing, you will be shown the applicable subscription price and billing period through the app and applicable app store.If you purchase TriedThat Solo, payment will be charged through the app-store account or payment method associated with the platform through which you complete the purchase.Unless you cancel the subscription in accordance with the applicable app store's requirements, TriedThat Solo will automatically renew for another subscription period and the applicable subscription price may be charged.Prices may vary by country, region, currency, taxes, or app-store pricing. Any price applicable to your purchase will be presented through the applicable purchasing platform.

8. Managing and Cancelling Your Subscription

You can manage or cancel your TriedThat Solo subscription through the subscription-management settings of the app store through which you purchased it.Cancellation generally stops future automatic renewal. Unless otherwise required by law or the applicable app-store rules, cancelling does not necessarily end access immediately; Solo access may continue until the end of the subscription period for which you have already paid.Deleting the TriedThat app does not cancel your subscription.Deleting your TriedThat account does not necessarily cancel your subscription.If you no longer want the subscription to renew, you are responsible for cancelling it through the applicable app-store subscription controls within the time required by that platform.

9. Purchases, Refunds, and Billing Issues

Purchases made through Apple, Google, or another third-party app marketplace are processed by that platform and are subject to its applicable payment, subscription, cancellation, and refund rules.Refund requests for purchases processed by an app store may need to be submitted directly to that app store.Lashachi Inc. may not have the ability to directly issue, approve, or process refunds for transactions handled by a third-party marketplace.Nothing in these Terms limits any refund, cancellation, statutory warranty, or consumer-protection right that cannot legally be excluded.If a purchase or subscription appears incorrectly in TriedThat, you may use the available Restore Purchases functionality or contact [email protected] for assistance.

10. RevenueCat and Subscription Verification

TriedThat uses RevenueCat to help manage purchases and determine whether an account is entitled to TriedThat Solo functionality.Subscription information received from RevenueCat and the applicable app store may be associated with your TriedThat account so that the service can determine whether Solo features should be available.TriedThat may verify subscription status with its backend rather than relying solely on information displayed by the mobile application.If subscription information cannot be verified temporarily because of an app-store, network, RevenueCat, or other technical issue, some Solo functionality may temporarily be unavailable until entitlement status can be verified or restored.

11. Your Content

You retain ownership of content you create and submit to TriedThat, subject to any rights belonging to others.You grant Lashachi a limited, non-exclusive license to host, process, reproduce, transmit, and otherwise use content you submit only as reasonably necessary to operate, maintain, secure, and provide TriedThat.This license does not give Lashachi ownership of your content.You are responsible for the content you enter into TriedThat and for ensuring that you have the right to use that content.

12. Photos and Local Storage

TriedThat may allow you to add an optional photo to a pet profile.Under the current architecture, pet profile photos are stored locally on your device rather than uploaded to the TriedThat backend.You are responsible for maintaining your device and any backups you consider necessary.Lashachi cannot guarantee recovery of locally stored photos if application data is deleted, the app is removed, or a device is lost, damaged, reset, or replaced.

13. Acceptable Use

You agree not to:• use TriedThat for unlawful, fraudulent, or abusive purposes;
• attempt to gain unauthorized access to another user's account or memories;
• interfere with or disrupt TriedThat's systems or security;
• probe, attack, or attempt to circumvent technical restrictions or authorization controls;
•upload, enter, or transmit content that infringes another person's rights;
• use automated systems to abuse or overload the service;
• reverse engineer TriedThat except to the extent such restriction is prohibited by applicable law; or
• use TriedThat in a manner that could damage the service or impair its availability to others.

14. Privacy

By using TriedThat, you acknowledge that you have had an opportunity to review the Privacy Policy.Our collection and handling of personal information is described in the TriedThat Privacy Policy, available at:

15. Account Deletion

TriedThat provides functionality to delete your account.Account deletion may permanently remove your account, pet profiles, server-saved memories, and other account-associated information, subject to legitimate legal, security, backup, fraud-prevention, and compliance retention requirements.Account deletion may also remove locally stored TriedThat information where supported by the application.Deleting your TriedThat account does not necessarily cancel an active subscription. 16. Service Availability and Changes

We may modify, update, suspend, limit, or discontinue features of TriedThat.We do not guarantee that TriedThat or any particular feature will always be available, uninterrupted, error-free, or compatible with every device or operating-system version.We may perform maintenance, respond to security incidents, change service providers, or modify infrastructure.Where required by applicable law, we will respect rights that cannot legally be excluded.

17. Discontinuation of TriedThat

We may discontinue TriedThat in the future.If we decide to discontinue material paid functionality, we will take reasonable steps to provide appropriate notice where practicable and comply with applicable law and app-store requirements.Purchases of TriedThat Solo do not constitute a promise that TriedThat or any particular feature will be available indefinitely. If paid functionality is materially changed or discontinued, Lashachi will comply with applicable law and relevant app-store requirements.

18. Third-Party Services

TriedThat relies on third-party platforms and service providers, which may include mobile operating systems, app stores, hosting providers, authentication or email providers, and subscription infrastructure.Your use of those third-party services may also be governed by their own terms and privacy policies.Lashachi is not responsible for third-party services except to the extent required by applicable law.

19. Lashachi Intellectual Property

TriedThat, the TriedThat name and branding, Lashachi branding, software, interfaces, designs, graphics, and other materials provided by Lashachi are owned by Lashachi or its licensors and are protected by applicable intellectual-property laws.Except for rights expressly granted under these Terms, no rights in Lashachi's intellectual property are transferred to you.

20. Feedback

If you voluntarily provide suggestions, ideas, or feedback about TriedThat, you agree that Lashachi may use that feedback without restriction or obligation to compensate you, subject to applicable law.This does not transfer ownership of your private TriedThat memories to Lashachi.

21. Suspension and Termination

We may restrict, suspend, or terminate access to TriedThat if reasonably necessary to:• protect the service or other users;
• respond to security threats or abuse;
• comply with law;
• enforce these Terms; or
• address material violations of these Terms.
You may stop using TriedThat at any time and may delete your account using the functionality provided.

22. Disclaimers

To the extent permitted by applicable law, TriedThat is provided on an “as is” and “as available” basis.We do not warrant that the service will be uninterrupted, error-free, completely secure, or that stored information will never be lost.TriedThat is a personal memory/recording tool that records personal observations and does not provide veterinary, medical, diagnostic, nutritional, or professional pet-care advice.Information recorded by users is not a diagnosis or recommendation.Users of TriedThat remain responsible for decisions concerning their pets. If a pet has a concerning reaction or health issue, users should seek appropriate professional veterinary advice.Nothing in these Terms excludes warranties or rights that cannot legally be excluded under applicable consumer-protection law.

23. Limitation of Liability

To the maximum extent permitted by applicable law, Lashachi Inc. and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to TriedThat, including loss of data, loss of access, or interruption of service.To the extent permitted by applicable law, Lashachi's aggregate liability arising out of or relating to TriedThat will not exceed the greater of:• the amount you paid to Lashachi for TriedThat during the 12 months immediately preceding the event giving rise to the claim; or
• CAD $100.
These limitations do not apply to liability that cannot legally be limited or excluded under applicable law, including any rights or remedies that cannot legally be waived.

24. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable in Alberta, without regard to conflict-of-law principles.Nothing in this section deprives you of mandatory consumer protections or other rights applicable to you that cannot legally be waived.

25. Changes to These Terms

We may update these Terms as TriedThat evolves.When we make changes, we will update the “Last updated” date.If changes are material, we may provide additional notice where appropriate or required by law.Your continued use of TriedThat after updated Terms take effect constitutes acceptance to the extent permitted by applicable law.

26. Entire Agreement

These Terms, together with the TriedThat Privacy Policy and any additional terms presented to you for specific TriedThat features, constitute the agreement between you and Lashachi concerning your use of TriedThat.If any provision is found unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
